The two (plaintiffs) MPs include Ashaiman constituency MP, Hon. Ernest Henry Norgbey and MP for the Juaboso Constituency, Hon. Kwabena Mintah Akandoh.
These two MPs of the opposition party are asking Supreme Court to cancel the swearing-in of newly appointed Gender Minister because of her failure to take on the compulsory national service, and also of her bad temperament hence she can’t be appointed as Minister.
According to Mr. Mintah Akandoh, Madam Otiko Afisa Djaba can’t hold herself out as a Gender Minister because she has not completed the mandatory national service and her appointment is against law.
‘According to a declaration that upon a right explanation of the provisions of the constitution mainly in the article 94 (2)(g) of the constitution is against section (7) of the Ghana National Service Act, Act 426. The first defendant is the attorney General Minister of Justice Ministries, Accra and second defendant Ms Otiko is disqualified from being approved and appointed as State Minister to assume a position in the Public Service.’
