Five of the nine Supreme Court juries who sat on the election petition Case are of the view that the meaning of over voting as described by NDC General Secretary, Johnson Asiedu Nketsia, still holds if elections were to be held today.
In the 588 page decision on the election petition Case that dared the legality of President Mahama, the five justices supported the definition of over voting as the number of votes that exceed the number of voters registered at a polling station.
This is as against Dr Mahamudu Bawumia, the second petitioner’s meaning of over voting.
Private legal practitioner, Samson Lardy Ayenini who has studied the judgment, clarifies the majority opinion in the judgment suggests Dr Bawumia’s meaning of over voting rather amounts to poll stuffing.
Also in the majority’s decision, the five Supreme Court justices contend the court could have well-ordered the improvement of errors on the pink sheets rather than the petitioners’ appeal that the errors should lead to the cancellation of votes.
