The Supreme Court has trashed Fafali’s application which pursued to stop the President from appointing a new Chairman of the Electoral Commission (EC).
Fafali Nyonator has filed an application wherein he called the removal of former EC Chairperson, Mrs. Charlotte Osei unlawful.
According to her, the Chief Justice committee violated the 1992 Constitution while taking the decision of removal of Mrs. Charlotte Osei.
Therefore, she wanted the court to stop President from appointing a new EC Chair till the final verdict of the substantive case.
The applicant also wanted the court to stop the President from going ahead with the process of final confirmation of the appointment of Mrs. Jean Mensa.
However, today a seven-member panel of the Supreme Court unanimously terminated the interlocutory application. The court further said the application was oppressed with errors.
Moreover, the court also held the application as unnecessary. The court had already the power to nullify the appointment of Mrs. Jean Mensah if the substantive case gets ahead.
The seven-member bench presided over by Mr. Justice Julius Ansah. Mr. Jones Doste, Mr Justice Anin Yeboah, Mr.Justice Paul Baffoe-Bonnie, Mr Justice Sule Gbadegbe, Mrs. Justice Vida Akoto Bamfo and Mr. Justice Yaw Appau also accompanied him as the other members.
